Book Description
"The material is useful to anyone needing a quick review of previous case law and regulations. It also addresses the history and legal processes involved in the IDEA and the delivery of instruction based on IDEA regulations. All of this is done in a concise format." Bill Killian, Principal Midway Middle School, Waco, TX "The major strength of this book lies in the fact that it provides information about legal issues in a way that appeals to educators. The authors do a good job of avoiding 'legal jargon' and instead rely on 'educational jargon,' which is, of course, more appropriate for the intended audience." Karen Bessette, Principal Randolph Elementary School, Universal City, TX Protect against costly litigation! Learning and referencing federal special education regulations will help you make the right placement and discipline decisions.Deciphering legal cases and terminology can be a daunting undertaking for any educator. This overwhelming task is compounded by the constant possibility that one wrong move can result in a costly lawsuit. To assuage this anxiety among administrators and teachers, two of the nation’s Education Law experts have written this indispensable, user-friendly guide, which comprehensively covers federal and state interpretations of education regulations. This guide is aimed at saving precious time and resources by thoroughly, yet succinctly, translating and explaining legal regulations—such as the Individuals with Disabilities Education Act (IDEA), Americans with Disabilities Act (ADA), and Section 504 of the Rehabilitation Act—so educators can more fully focus on providing the services their students need. The chapters contain cases, definitions, guidelines, and examples designed to help administrators make preventative decisions regarding placement, planning, and discipline that are in line with the many statutes and regulations that can impact a school site. Relevant topics that all educators will find useful include:Legal requirements of special education students and disciplinary actions Legal interpretations of the IEP (Individualized Education Program) Legal definitions of parental rights and responsibilities Court decisions surrounding least restrictive environment and student placement Discussion and coverage of parochial schools and their unique considerations

SYNOPSIS

In 1975 Congress mandated that eligible students with disabilities be provided with appropriate special education services. Since then the law, the Individuals with Disabilities Education Act, or IDEA, has created a web of legal obligations for school administrators to track. This reference examines how federal and state courts have interpreted the statute and outlines the substantive and procedural requirements that the IDEA, its regulations, and litigation place on schools. Topics include rights of access to a free and appropriate public education, procedural due process, placement requirements, delivery of related services, disciplinary issues, and remedies for failure to adhere to the law. Co-author Osborne is a principal in Quincy, MA, and Russo teaches education and law at the U. of Dayton. Annotation ©2004 Book News, Inc., Portland, OR
